EROAD Safety Star – Driver of the Year Competition

Terms and Conditions

  1. Entry Dates & Times. This Promotion runs from 12:01am September 12, 2021 and ends 11:59pm October 29, 2021.
  2. Entry. This competition is open to full-time professional drivers (employee or contractor_ (“Driver”), who has been in continuous service for one (1) year with an EROAD Customer (“Customer”). The Driver must be nominated by the Customer. The Customer may nominate up to five (5) Drivers. Customers need to complete the EROAD Safety Star Nomination Form, and forward to: safetystar@eroad.com. All competition applications will be audited for accuracy. False information provided in the application will result in disqualification. Judge’s discretion applies. At the end of the judging period, there will be five (5) Finalists chosen to win the EROAD Safety Star – Driver of the Year Award (“Winner”). If a Customer’s Driver is chosen as a possible Finalist, the Customer must provide documentation to verify its nomination form, which may include motor vehicle reports, driver’s license, and medical card.
  3. Prizes. The first ten (10) drivers nominated by a Customer will receive a special edition EROAD Safety Star hat. The five (5) Finalists chosen will receive an EROAD-branded travel mug and a $100 Visa® card. The Winner will receive a $500 Visa® card, an EROAD Safety Star – Driver of the Year T-shirt and the EROAD Safety Star – Driver of the Year Trophy. The prizes must be taken as stated and cannot be transferred. Drivers must be employed by the Customer at the time of winning and redeeming their Prize. Refer to Point 2 (above_. Judge’s discretion applies. If a Prize becomes unavailable for reasons beyond EROAD’s control, EROAD may substitute a Prize of equal or greater value.
  4. Finalists & Winner. The Winner will be selected from the five (5) Finalists and announced in mid-November 2021. The Finalist are subject to verification, including without limitation, verification of eligibility and compliance with these Terms and Conditions. Participation constitutes Entrant’s full and unconditional agreement to be bound by these Terms and Conditions. The Finalists will be notified by email, phone (voice or text), mail or in person and must be available for the preparation of all publicity that may be required by EROAD. Where attempts to contact the Winner fail (e.g. when the Winner cannot be contacted by phone after three attempts or mail sent is returned) the Judge will select another Winner. The Customer, whose Drivers have been selected as Finalists will also be notified accordingly. Winning and being awarded the Prize is contingent upon fulfilling all requirements outlined for Finalists and Winner. The Judge’s determination of the Finalists and the Winner will be final.
  5. Permissions. By participating in the EROAD Safety Star – Driver of the Year competition, Drivers grant EROAD exclusive permissions to use their names, photographs, videos, voices and likeness in connection with the competition, and waive any claims to royalty, right or remuneration for such use. In addition, Drivers agree that their entries may be used for educational and training purposes. All Drivers’ personal details must be valid and up to date and will be held and used by EROAD in connection with this competition. All Drivers personal information may be accessed and amended at the Entrant’s request, and in accordance with EROAD’s Privacy Policy found herein: https://www.eroad.com/privacy-policy/ . Entrant represents and warrants that its Entry is: (a) wholly original; (b) does not include any material that would require the consent of any third party; and (c) does not violate any copyright, moral right, trade mark, publicity right, or any other right of any third party.
  6. Limitations. Entries must be received at the expiry of the date and time stated in Point 1 (above). Entries tendered by any method other than as set out in Point 2 (above) are void. EROAD is not responsible for any entries that are damaged, altered, deleted, destroyed, fraudulent, incomplete, invalid, late, lost, misrouted, non-delivered, stolen, tampered with, unauthorized or unintelligible. This competition is subject to all applicable laws and regulations and is void where prohibited by law.
  7. Modification or Termination of Competition. In its sole discretion, EROAD has the right to cancel, terminate or suspend the competition; and in such an event, to select from among all eligible Entries received up to such time of cancellation, termination or suspension, or to cancel the competition and not award any Prize. Because of the unique nature and scope of the competition, EROAD reserves the right, in addition to those other rights reserved herein, to modify any date(s) or deadline(s) set forth in these Terms and Conditions or otherwise governing this competition.
  8. Indemnification. By participating, Drivers, to the extent permitted by law, agree to release and hold harmless EROAD, its affiliates, and their respective employees, directors, officers and agents, from any and all liability for loss, harm, damage, claim, injury, cost or expense whatsoever which may occur as a result of participating in this competition or with the Prize offered including inability to travel or redeem the Prize for any reason, or as a result of EROAD’s negligence.
